After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record, as well as applicable statutes, regulations, and policies. In addition, the Board considered the advisory opinion contained in Enlisted Career Progression memorandum 1430 PERS 8031/0405 of 12 December 2019 and your response to the opinion. On 22 April 1978, you enlisted for 6 years in the U.S. Navy Reserve. On 25 July 1978, you entered active duty in the U.S. Navy. On 16 July 1980, you were advanced to CTO3/E-4. On 29 August 1981, you were released from active duty as a CTO3/E-4 from . Furthermore, your DD Form 214 listed a Navy Expeditionary Medal and 2 years, 6 months, and 22 days of Foreign Service. On 21 April 1985, you were discharged as a CTO3/E-4. On 24 May 2007, a transmittal of and/or entitlement to awards was issued listing a Navy Expeditionary Medal. You requested to be promoted to CTO2/E-5 while on active duty, and be awarded the Navy and Marine Corps Overseas Service Ribbon and Navy and Marine Corps Achievement Medal. The Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that there is no evidence in your record that shows that you were recommended for advancement, participated in the CTO2/E-5 exam, were selected, or advanced to CTO/E-5. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. Under Title 10, United States Code, Section 1552, the Board may only correct service records based on errors or injustices and may do so only after other avenues of administrative relief have been exhausted. You should request relief from Navy Personnel Command (PERS-31) regarding being awarded the Navy and Marine Corps Overseas Service Ribbon and Navy and Marine Corps Achievement Medal. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records.
