Pursuant to the provisions of reference (a), Petitioner, a former enlisted member of the Marine Corps, filed enclosure (1) requesting an administrative change to his Report of Separation from the Armed Forces of the United States (DD Form 214) to reflect his correct date of birth (DoB). Petitioner’s original service number was . 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 21 May 2020, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service and medical records, applicable statutes, regulations, policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interests of justice to review the application on its merits. c. The Petitioner enlisted in the Marine Corps and began a period of active service on 18 November 1951. On 18 November 1953, Petitioner was released from active duty with a general (under honorable conditions) characterization of service. d. The DoB as reflected on Petitioner’s DD Form 214 is “.” However, the Petitioner provided a copy of his birth certificate reflecting his correct DoB. CONCLUSION: Upon review and consideration of all the evidence of record, the Board concludes that Petitioner’s request warrants relief. RECOMMENDATION: In view of the foregoing, the Board finds the existence of an error warranting the following corrective action. That Petitioner be issued a “Correction to DD Form 214, Certificate of Release or Discharge from Active Duty” (DD Form 215), to indicate that his DoB in Block 10 of his original DD Form 214 is changed from “” to “.” Following the correction to the DD Form 214 indicating the correct DoB, that all other information currently listed on such DD Form 214 remains the same. That in the event that Petitioner’s DD Form 214 is obsolete and cannot be corrected through the use of a DD Form 215, that Petitioner be issued a new DD Form 214, Certificate of Release or Discharge from Active Duty, reflecting the recommended correction above. That a copy of this report of proceedings be filed in Petitioner’s naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner's application was received by the Board on 29 April 2019. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
