Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to block 17c of his Report of Transfer or Discharge (DD Form 214N) dated 1 August 1968. Petitioner case was reconsidered in accordance with Board procedures that conform to Lipsman v. Sec’y of the Army, 335 F. Supp. 2d 48 (D.D.C. 2004).” 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 19 May 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 16 November 1965, Petitioner enlisted in the Navy Reserve on a six year contract. c. On 5 February 1966, Petitioner entered a period of active duty for training for a total of 14 days. d. On 9 August 1966, Petitioner commenced a 24 month period of active duty. e. On 1 August 1968, Petitioner was released from active duty and transferred to the Navy Reserve. f. On 15 November 1971, Petitioner was discharged. CONCLUSION Upon review and consideration of all the evidence of record, the Board agreed that Petitioner’s date of entry on his DD Form 214 is erroneously dated after the date of discharge. The Board does not agree that Petitioner’s DD Form 214 should be changed to Petitioner’s Pay Entry Base Date (PEBD) of 16 November 1965. The Board finds the existence of an injustice warranting the following partial corrective action. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s Report of Transfer or Discharge (DD Form 214N) dated 1 August 1968, block 17c is changed to “9 August 1966” vice “16 November 1968”. In so far as Petitioner's request for corrective action that exceeds the foregoing, the Board did not agree with Petitioner’s request to change his DD Form 214 block 17c date to the PEBD of 16 November 1965. The intent of a DD Form 214 is to provide a brief, clear-cut record of a period or term of [a]ctive military service. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
