Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner took her graduation leave from “27 July 2018” to “11 August 2018”. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 5 May 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 25 May 2018, Petitioner graduated from the and was commissioned as an Ensign in the U.S. Navy. Furthermore, Petitioner was attached to the for temporary duty. c. On 23 July 2018, graduation leave 26 May 2018 to 24 June 2018 (30) was ran by cognizant authority. d. On 27 July 2018, Petitioner’s temporary duty was terminated. e. On 16 August 2018, delay en route/PCS leave 27 July 2018 to 11 August 2018 (16) was ran by cognizant authority. f. On 14 August 2018, Petitioner arrived to for duty under instruction. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner’s graduation leave was ran erroneously while on temporary duty at the Naval Academy. Later, Petitioner was erroneously charged with 16 days while in route to her school. Furthermore, Petitioner had 3 months between her graduation and before reporting to the first duty location or port of embarkation in order to use her graduation leave. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner took graduation leave from “27 July 2018” to “11 August 2018” vice “26 May 2018” to “24 June 2018”. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
