Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner’s Certificate of Release or Discharge from Active Duty (DD Form 214) block 12a. reflect 13 December 1985 vice 23 December 1985. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 7 June 2019 and, pursuant to its regulations, determined that the corrective action indicated below be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 26 July 1982, Petitioner entered active duty in the U.S. Marine Corps. c. On 13 December 1985, Petitioner reenlisted for 5 years. d. On 30 September 2002, Petitioner was transferred to the Fleet Marine Corps Reserve with 20 years, 2 months, and 5 days. Furthermore, Petitioner was issued a DD Form 214 with errors to blocks 12a (Date entered AD this period) reflecting 23 December 1985 vice 13 December 1985; block 12c (Net active service this period), reflecting 16 years, 8 months, and 20 days vice 16 years, 9 months and 18 days; and block 12d (Total prior active service), reflecting 3 years, 5 months, and 15 days, vice 3 years, 4 months, and 17 days. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. Due to administrative error prior to retirement, Petitioner’s DD Form 214 effective 30 September 2002 reflected errors to blocks 12a, 12c, and 12d. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The Certificate of Release or Discharge from Active duty (DD Form 214), executed on 30 September 2002 is modified to read block 12a (Date entered AD this period) “13 December 1985” vice “23 December 1985”; block 12c (Net active service this period), “16 years, 9 months and 18 days” vice “16 years, 8 months, and 20 days”; and block 12d (Total prior active service), “3 years, 4 months, and 17 days” vice “3 years, 5 months, and 15 days”. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulation, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
