Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to be transferred to the Retired Reserves awaiting pay at age 60. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 9 July 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of the Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 21 February 1989, Petitioner entered the Marine Corps Reserve. c. On 1 May 2017, Petitioner was promoted to Master Gunnery Sergeant. d. On 15 February 2019, Petitioner was discharged. CONCLUSION Upon review and consideration of all the evidence of record, the Board agreed that Petitioner submitted the necessary administrative action request to be able to retire in the grade of Master Gunnery Sergeant (MGySgt). The Board agreed that Petitioner should have been allowed to be transferred to the Retired Reserve due to his satisfactory years of qualifying service. The Board agreed that a time in grade waiver is warranted and finds the existence of an error warranting the following corrective action. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s discharge dated 15 February 2019 is rescinded. Petitioner submitted to be transferred to the Retired Reserves awaiting pay at age 60 and it was approved by cognizant authority with an effective date of 31 January 2019 and that the Petitioner was granted a Time in Grade (TIG) waiver for Master Gunnery Sergeant/E-9. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
