Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to have reserve credit points added to the anniversary years ending on July 5, 1978 - 17 points, July 5, 1979 - 12 points, July 5, 1988 - 87 points, July 5, 1989 - 53 points, July 5, 1991 - 38 points, and June 30, 1994 - 49 points. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on March 27, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. An extensive review of the Petitioner’s official military personnel file was conducted. c. Petitioner’s reserve retirement credit report ending July 5, 1978 reflects 47 active duty points, 40 paid drills, and 7 correspondence points. Total active duty points 47, 60 inactive duty points for 107 total points credited. d. Petitioner’s record indicates 12 correspondence points earned from August 14, 1978 through April 3, 1978. e. Petitioner’s reserve retirement credit report ending July 5, 1989 reflects 98 active duty points and 32 paid drills. Total active duty points 98 and 47 inactive duty points for 145 total points credited. f. Petitioner’s reserve retirement credit report (IMA) of July 6, 1990 through October 31, 1990 reflects 38 active duty points and no others. These 38 points are not resident on Career Retirement Credit report for the anniversary year of July 6, 1990 – July 5, 1991. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants partial favorable action. This opinion was provided to the Petitioner for comment in which he provided for the Board’s review and consideration. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following partial corrective action. The Board determined the relief for the anniversary years of 1978, 1979, 1989, and 1991-warranted adjustment. However, no evidence was available to warrant adjustment to the anniversary years ending July 5, 1988 and June 30, 1994. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’ reserve Career Retirement Credit Report reflect the following: Three (3) additional paid drill points and sixteen (16) additional active duty points be added to the anniversary year ending July 5, 1978. Add twelve (12) non-paid drills to the anniversary year ending July 5, 1979. Add fifty-three (53) additional active duty points to the anniversary year ending July 5, 1989. Add thirty-eight paid drill points to the anniversary year ending July 5, 1991. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
