Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner’s PayEntryBase Date (PEBD) has been adjusted to reflect previous Marine Corps service. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 13 September 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 1 December 1997, Petitioner enlisted in U.S. Marine Corps Reserve for 8 years. c. On 25 January 1998, Petitioner was assigned to active duty for training (Officer Candidates School); however, he was separated due to a medical injury on 12 March 1998. d. On 21 June 1999, Petitioner enlisted in U.S. Navy Reserve. e. On 25 August 1999, Petitioner was assigned to active duty for training (Officer Candidates School) and was discharged on 23 November 1999, in order to accept a commission in the U.S. Navy. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. Due to an administrative oversight, Petitioner’s PEBD was erroneously calculated when he entered in the U.S. Navy. The Navy failed to add his active service in the U.S. Marine Corps. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Block 7a (Total Active Military Service) of the DD Form 4/1 (Enlistment/reenlistment document armed forces of the United States) is modified to read “00 years 01 months, 18 days” vice “blank” executed on 21 June 1999. Note: Petitioner’s PEBD should reflect 7 July 1999 vice 25 August 1999. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
