Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner was eligible for and received a FY19 Special Duty Assignment (SDA) Kicker. 2. The Board, consisting of , reviewed Petitioner’s corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 11 October 2011, Petitioner entered active duty. c. On 5 July 2017, MARADMIN 350/17 (MCBul 7220. Fiscal Year 2018 (FY18) Selective Retention Bonus (SRB) Program and FY18 Broken Service SRB (BSSRB) Program) was published and stated that “Special Duty Assignment (SDA) Kicker. Zone A, B, and C Marines who submit a 48 month reenlistment in which they volunteer for an initial Free Military Occupational Specialty (FMOS) of 0911, 8411, or 8156 from 5 Jul 17 to 31 Dec 17 will rate a 20,000 reenlistment kicker in addition to the SRB allotted to the Marines PMOS. The awarding of the FMOSs 0911, 8411, or 8156 predicates the payment of the SDA kicker. Marines who are in training beyond 30 Sep 18 will be authorized payment of the SDA Kicker once MCTFS shows they have been awarded the new FMOS. The SDA kicker is open to all PMOSs who gain the FMOSs mentioned above.” d. On 21 July 2017, MARADMIN 381/17 (FY19 Headquarters Marine Corps Special Duty Assignment Volunteer Period (SDAVP)) was published and stated that “DuringFY19 SDAVP HQMC is accepting volunteers from all MOSs. The following MOSs have open FY18 SDA allocations and are accepting volunteers for assignment to FY18 classes: 0111, 0311, 0369, 0619, 0629, 0648, 065X, 0689, 0699, 26XX, 28XX, 3043, 3051, 61XX, 621X, 622X, 6276, 7372.” e. On 15 August 2017, Petitioner’s Careerist Active Duty SDA with Extension / DI Duty request was submitted, and approved by HQMC on 4 December 2017. f. On 8 December 2017, Petitioner extended for 32 months in order to obligate service for assignment to DI-E. Petitioner’s End of Current Contract (ECC) was 5 August 2019 g. On 2 July 2018, MARADMIN 370/18 (MCBul 7220. Fiscal Year 2019 (FY19) Selective Retention Bonus (SRB) Program and FY19 Broken Service SRB (BSSRB) Program) was published and stated that “Special DutyAssignment (SDA) Kicker. Zone A, B, and C Marines who submit a 48 month reenlistment in which they volunteer for an initial Free Military Occupational Specialty (FMOS) of 0911, 8411, or zone B and C Marines who volunteer as Marine Security Guard Detachment Commander from 5 Jul 18 to 31 Dec 18 will rate a 20,000 dollar SDA Kicker in addition to the PMOS bonus amount listed in section(s) 3.m, 3.n, and 3.o. The awarding of the FMOSs 0911, 8411, or the completion of Marine Security Guard Detachment Commander School predicates the payment of the SDA kicker. Marines who are in training beyond 30 Sep 19 will be authorized payment of the SDA Kicker once MCTFS shows they have been awarded the new FMOS or once MCTFS shows they have completed the. The SDA kicker is open to all PMOSs who meet the prerequisites mentioned above. If no PMOS bonus is listed in section(s) 3.m, 3.n, and 3.o, the Marine rates a lump sum bonus of 20,000 dollars.” h. On 5 July 2018, MARADMIN 379/18 (Fiscal Year 2020 (FY20) Headquarters Marine Corps Special Duty Assignment Volunteer Period (SDAVP)) was published and stated that “During FY20 SDAVP HQMC is accepting volunteers from all MOSs. The following MOSs have open FY19 SDA allocations and are accepting volunteers for assignment to FY19 classes: 0369, 04XX, 0629, 0639, 0671, 0679, 0681, 0688.” i. On 1 October 2018, Petitioner was promoted to E-6. j. On 12 October 2018, Petitioner’s Careerist Active Duty Reenlistment request was submitted, and was approved by HQMC on 28 November 2018. Petitioner’s ECC was 5 August 2019 and End of Active Service (EAS) was 5 April 2022. k. On 11 December 2018, Petitioner reenlisted for 4 years. Furthermore, no reenlistment incentives were listed. l. On 4 January 2019, Petitioner attended Drill Instructor school, and graduated on 22 March 2019 with a FMOS of 0911. m. On 23 January 2020, Commanding General,, approved Commanding Officer, request effective 15 December 2019 for relief for “Good of the Service” for medical reasons, FMOS of 0911 was voided. Petitioner was also recommended for future special duty assignments, and had the potential for reenlistment and future service. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), (c), (d), and (e) the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner was counseled to extend vice reenlist in 2017 because he did not meet FY-18 End of Current Contract (ECC) requirements. The Board also concluded that Petitioner volunteered for the program, was approved, and later reenlisted prior to attending the Drill Instructor school, however, Petitioner’s reenlistment term did not meet the 48 month of obligated service. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged on 10 December 2018 and reenlisted on 11 December 2018 for a term of 4 years and 8 months vice 4 years. Note: This change will entitle the member to a $20,000 Special Duty Assignment (SDA) Kicker. Furthermore, Petitioner was relieved for “Good of the Service” for medical reasons effective 15 December 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
