Pursuant to the provisions of the reference, Petitioner, an enlisted member of the Marine Corps, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her record be corrected by removing an Administrative Remarks (page 11) counseling entry and several duplicate entries from her official military personnel file (OMPF). 2. The Board, consisting of , reviewed Petitioner's allegations of error and injustice on 9 June 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, she failed to exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner was issued enclosure (2), a 30 April 2018 page 11 entry notifying Petitioner that she is being processed for administrative separation for failing the Body Composition Program (BCP). Petitioner contends that she was not processed for administrative separation because she was within Marine Corps height and weight standards. CONCLUSION Upon review and consideration of all the evidence of record, the Board determined that Petitioner’s request warrants relief. After a review of Petitioner’s OMPF, the Board found no evidence that Petitioner was processed for administrative separation. The Board determined that the counseling entry was issued in violation of Marine Corps Order (MCO) 1070.12K, the Marine Corps Individual Records and Administration Manual (IRAM). Specifically, commanders are not to make entries on page 11 which concern administrative discharge proceedings if the proceedings do not result in an administrative discharge. The Board also determined that although Petitioner failed to exhaust her administrative remedies, Petitioner’s record contains duplicate page 11 entries that shall be removed. The Board thus concluded that Petitioner’s 30 April 2018 page 11 entry is in error and shall be removed. RECOMMENDATION In view of the above, the Board directs the following corrective action. Petitioner’s naval record be corrected by removing her 30 April 2018 page 11 counseling entry. Petitioner’s naval record be corrected by conducting an audit of her record and removing her duplicate page 11 entries. Any material or entries inconsistent with or relating to the Board’s recommendation be corrected, removed, or completely expunged from Petitioner’s record, and no such entries or material be added to the record in the future. This includes, but is not limited to, all information systems/database entries that reference or discuss the material being expunged. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
