Pursuant to the provisions of the reference, Petitioner a former enlisted member of the Marine Corps, filed the enclosure with this Board requesting correction to his name on his Report of Separation from the Armed Forces of the United States (DD Form 214). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 22 July 2020, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, as well as applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although the enclosure was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner entered in the Marine Corps and began a period of active duty on 16 June 1953. His enlistment documents indicate his name as , but Petitioner signed his name as . d. On 5 August 1955, Petitioner was honorably discharged. At the time of his discharge he was issued a DD Form 214 with the name . Petitioner was informed there was no time to correct the document as he had to catch a train to go home. e. Petitioner provided a certified copy of the , Birth Registrar which reflect the following name: . CONCLUSION: Upon review and consideration of all the evidence of record, the Board determined the Petitioner’s request warrants favorable action. The Board notes the Petitioner’s DD Form 214 incorrectly reflects his name. The Board notes that Petitioner has provided legal evidence which reflects his correct name . In view of the above, the Board directs the following corrective action. RECOMMENDATION: That Subject be issued Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215) for period of active duty ending on 5 August 1955 to reflect Petitioner’s correct name as . That Petitioner be issued an honorable discharge certificate with the name That a copy of this Report of Proceedings be filed in Subject’s Naval record. That, upon request, the Department of Veterans Affairs be informed that Subject’s application was received by the Board on 3 June 2019. 4.
