Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner reenlisted in zone “C” vice zone “D”, and was entitled to a Special Duty Assignment (SDA) Kicker. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 9 June 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 13 January 2015, Petitioner reenlisted for 4 years with a new expiration of current contract (ECC) of 12 January 2019. c. On 2 July 2018, MARADMIN 370/18 (MCBul 7220. Fiscal Year 2019 (FY19) Selective Retention Bonus (SRB) Program and FY19 Broken Service SRB (BSSRB) Program) was published and stated that Zone A, B, and C Marines who submit a 48 month reenlistment in which they volunteer for an initial Free Military Occupational Specialty (FMOS) of 0911, 8411, or zone B and C Marines who volunteer as Marine Security Guard Detachment Commander from 5 Jul 18 to 31 Dec 18 will rate a 20,000 dollar SDA Kicker in addition to the PMOS bonus amount listed in section(s) 3.m, 3.n, and 3.o. The awarding of the FMOSs 0911, 8411, or the completion of Marine Security Guard Detachment Commander School predicates the payment of the SDA kicker. Marines who are in training beyond 30 Sep 19 will be authorized payment of the SDA Kicker once MCTFS shows they have been awarded the new FMOS or once MCTFS shows they have completed the Marine Security Guard Detachment Commander School. The SDA kicker is open to all PMOSs who meet the prerequisites mentioned above. If no PMOS bonus is listed in section(s) 3.m, 3.n, and 3.o, the Marine rates a lump sum bonus of 20,000 dollars. d. On 24 August 2018, Petitioner’s Careerist Active Duty SDA with Reenlismtent/MSG duty was submitted, and was approved by Headquarters, U.S. Marine Corps on 17 October 2018. e. On 13 September 2018, Petitioner crossed from zone “C” to zone “D”. f. On 26 October 2018, Petitioner reenlisted for 4 years with no listed incentives. g. On 12 October 2019, Petitioner was attached for Marine Security Guard school, and graduated on 13 December 2019. h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that due to the processing time of Petitioner’s Careerist Active Duty SDA with Reenlismtent/MSG duty request at HQMC, he crossed from zone “C” to zone “D” making him ineligible for a SDA kicker. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 11/12 September 2018, vice on or about 25/26 October 2018 for a term of 4 years and 5 months vice 4 years. Note: This change will entitle the member to a Special Duty Assignment (SDA) Kicker with an award payment of $20,000. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
