Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to receive two years of Entry Grade Credit (EGC). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 28 May 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 3 September 2013, Petitioner reenlisted in the Navy Reserve. c. On 1 September 2016, Petitioner was commissioned. d. On 30 September 2016, Petitioner completed his residency. e. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner's application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board agreed that Petitioner completed three years of residency which he would have been eligible for an additional two years of EGC. The Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner earned a total of “6 years, 0 months, and 0 days” vice“4 years, 0 months, and 0 days” of EGC. Note: Petitioner was credited 2 years of EGC for completion of his residency. Petitioner’s date of rank to LT is changed to “1 September 2014” from “1 September 2016.” Note: NPC is to assign the appropriate lineal number. Note: The change to the date of rank to LT/O-3 may have affected Petitioner's LCDR/O-4 advancement opportunity. If Petitioner was eligible for a selection board because the above change had not yet been made, the following procedures will apply to remediate that missed opportunity. Petitioner should submit a request for a special selection board (SSB) to NPC, PERS-80. PERS-80 can be reached at 901-874-4526. If all requirements are met for eligibility of a SSB and Petitioner’s request for an SSB is disapproved by NPC, Petitioner may reapply to this Board for consideration of an SSB. Petitioner should submit a DD Form 149, command endorsement/ recommendation, and must include a copy of this letter with the request, a copy of the denial letter from NPC, and all supporting documentation in accordance with the respective regulation for adjudication from this Board. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
