Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to reflect his lost Reserve Credit Points be restored and his file be forwarded to the Headquarters Marine Corps (HQMC) Special Selection Board (SSB) for review for promotion to Lieutenant Colonel in the Select Marine Corps Reserve. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 18 October 2019 and, pursuant to its regulations, determined that the partial corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 8 April 1999, Petitioner enlisted in the U.S. Marine Corps Reserve under the Platoon Leaders Class (PLC) program; however, he was dis-enrolled on 4 January 2000. c. On 29 June 2000, Petitioner enlisted in the U.S. Marine Corps Reserve under the Platoon Leaders Class (PLC) program. d. On 1 September 2000, Petitioner was commissioned as a Second Lieutenant in the U.S. Marine Corps Reserve. e. On or after 2010, Petitioner’s anniversary year ending date of 28 June 2010 was changed to reflect 7 April 2010, establishing a new anniversary date of 8 April 2010. f. Petitioner’s Career Retirement Credit Record (CRCR) dated 12 April 2019, contained two partial years (8 April 1999 to 4 January 2000, and 29 June 2009 to 7 April 2010). CRCR reflected the following totals: Inactive duty correspondence points: 62 Inactive duty points paid: 256 Inactive duty points non-paid: 2 Membership points: 265 Total inactive duty points: 585 Active duty points paid/total active duty points: 5420 Total points credit: 5859 Total satisfactory years: 17 Total qualifying years: 18 years, 6 months, 6 days g. Petitioner’s CRCR dated 21 May 2019, contained one partial year (8 April 1999 to 4 January 2000), and 7 missing correspondence points. CRCR reflected the following totals: Inactive duty correspondence points: 55 Inactive duty points paid: 256 Inactive duty points non-paid: 2 Membership points: 266 Total inactive duty points: 579 Active duty points paid/total active duty points: 5380 Total points credit: 5824 Total satisfactory years: 17 Total qualifying years: 17 years, 8 months, 27 days h. Petitioner’s CRCR dated 10 October 2019, contained one partial year (8 April 1999 to 4 January 2000). CRCR reflected the following totals: Inactive duty correspondence points: 55 Inactive duty points paid: 256 Inactive duty points non-paid: 2 Membership points: 272 Total inactive duty points: 585 Active duty points paid/total active duty points: 5532 Total points credit: 5967 Total satisfactory years: 18 Total qualifying years: 18 years, 8 months, 27 days i. On 31 July 2019, and 17 October 2019, Headquarters, U.S. Marine Corps provided advisory opinions. They stated that a previous audit to his CRCR shows a correction was made to his anniversary years removing a partial year 29 June 2009 to 7 April 2010. After the audit to the CRCR this previous partial year currently shows as a complete satisfactory year. Recommend that 7 additional correspondence points be added to the anniversary year ending 28 June 2017. j. On 22 August 2019, Headquarters, U.S. Marine Corps provided an advisory opinion. They stated that Petitioner’s application does not demonstrate that the error in question caused an unfair portrayal of his career thereby impacting his selection to Lieutenant Colonel before the FY20 USMCR Lieutenant Colonel Promotion Selection Board (PSB) convened. Rather, the error prior to being corrected on 20 May 2019, was to the benefit of Petitioner before the Lieutenant Colonel PSB. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosures (2), (3), and (4), the Board finds the existence of an injustice warranting the following partial corrective action. The Board concluded that from April to May of 2019, Petitioner’s correction to his anniversary year changed his partial year (29 June 2009 to 7 April 2010) to a satisfactory year. It also reduced the number of points for correspondence courses by 7. By 10 October 2019, no other additional errors with Petitioner’s CRCR were found. Furthermore, the Board concluded that there is no justification for an SSB. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was credited with 7 correspondence points for the anniversary year ending 28 June 2017. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
