Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to reflect the Reserve anniversary year from March 20, 2018 through March 19, 2019 be adjusted to a satisfactory year of service for retirement purposes. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on January 17, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner’s date entered armed forces date is March 20, 2004. c. On May 7, 2017, Petitioner is released from active duty and enters the Individual Ready Reserve (IRR). Petitioner’s anniversary year ends on March 19th each year. d. Petitioner contends that during the anniversary ending on March 19, 2019 that while trying to complete a correspondence course via MarineNet courseware the network went down on March 15, 2019 for maintenance. He asserts that the MarineNet managers told him that the website maintenance would be complete on March 19, 2019 however, it did not become available until March 22, 2019. He completed the course work on that date however, he did receive reserve points credit for the year ending March 20, 2019 thus receiving and unsatisfactory year for retirement purposes with a total of 46 points. e. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. They stated when MarineNet became unavailable the Petitioner was unable to complete the 4 point course prior to the close of his anniversary year that ended on March 19, 2019. This left him 4 points short from completing his 15th consecutive satisfactory. They believe it was an injustice and recommends that the Petitioner’s request be approved and four correspondence points be moved from his current anniversary year to his prior anniversary year ending March 19, 2019. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded the maintenance conducted on the MarineNet courseware prevented the Petitioner from completing his correspondence course and earning the four necessary points to have a satisfactory year by March 19, 2019. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The appropriate service headquarters authorized the movement of 4 correspondence points from the Petitioner’s current anniversary year to the anniversary year ending on March 19, 2019 and that anniversary year reflect 50 reserve credit points and a satisfactory year. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
