After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 6 September 2019. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. On 14 April 2016, you enlisted in the Army Reserve for 4 years. On 16 May 2016, you entered active service with the U.S. Army. On 5 May 2018, a request for conditional release was approved by the U.S. Army, and on 15 November 2018, you were administered your oath of enlistment in the U.S. Navy in the Surface Warfare Officer Program. On 15 November 2018, you were issued active duty orders to Officer Candidate School effective no earlier than 1600 on 24 November 2018 no later than 0900 on 25 November 2018. On 24 November 2018, you were discharged from U.S. Army in order to enter Officer Training Program. On 28 February 2019, you were discharged in order to accept commission. On 1 March 2019, you were commissioned an Ensign in the U.S. Navy. You requested the date of your enlistment in the U.S. Navy reflect 24 November 2018 vice 15 November 2018 due to your continued service in the U.S. Army; the Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that your Army discharge date is erroneous. All Navy documentation lists 15 November 2018 as your first day you affiliated with the U.S. Navy. Furthermore, your Pay Entry Base Date (PEBD) erroneously reflects when you entered active duty in the U.S. Army as 15 May 2016 vice 16 May 2016. Your PEBD can be fixed via your Personnel Support Detachment. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
