Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to recalculate final multiple score (FMS) for Navy Wide Advancement Exam (NWAE) September 2015 (Cycle 228) and request back pay upon adjustment of effective date of advancement to E-5. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 25 October 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner received an Evaluation report & counseling record for the period of 24 January 2014 to 31 August 2014 listed promotion recommendation of “Promotable” as a CTMSN. c. Petitioner received an Evaluation report & counseling record for the period of 1 September 2014 to 15 June 2015 listed promotion recommendation of “Early Promote” as a CTM3. d. In September 2015, Petitioner took the NWAE Cycle 228, and scored a PMA/Evaluation Average of 48.00/3.80. Petitioner’s Final/Minimum Multiple Required was 98.10/106.98. e. On 16 December 2016, Petitioner was advanced to E-5. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner’s Evaluation report & counseling record for the period of 24 January 2014 to 31 August 2014 as a CTMSN was erroneously used when calculating his performance mark average (PMA) resulting a lower score from 64 points to 48 points. The Petitioner’s record only reflects one qualifying evaluation, which contained a mark of “Early Promote” for calculation of PMA. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's Examination Profile Information and Exam Status sheet from the September 2015 (Cycle 228) Navy Wide Advancement Exam (NWAE) is modified to read PMA (Performance Mark Average) is "64 (4.00)" vice "48 (3.80)", and FMS (Final Multiple Score) is "114.10" vice "98.10". Note: the Minimum Multiple Required was 106.98. Petitioner advanced to E-5 effective “16 June 2016”vice “16 December 2016”, with a time in rate date of 1 January 2016. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
