Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to an Enlistment Bonus for Source Rate (EBSR). 2. The Board, consisting reviewed Petitioner’s allegations of error and injustice on 28 June 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of the Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action: Petitioner was placed in the Delayed Entry Program (DEP) on 22 August 2017, and Petitioner was selected for the Culinary Specialist (CS/5YO) Class “A” School Guarantee with a projected shipping date of 7 August 2018. Petitioner’s shipping date was modified to reflect 23 January 2018. On 8 February 2018, the updated Enlistment Bonus Program retroactively provided entitlement to CS/5YO who DEP on or after 20 December 2017 and ship to recruit training between January 2018 through March 2018. Since Petitioner met the provisions of the governing Enlistment Bonus policy, an Enlistment Guarantee Annex “B” should have been created, and entitled Petitioner to an Enlistment Bonus and Enlistment Bonus for Shipping. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner executed an Enlistment Guarantee (NAVCRUIT 1133/52) Annex “B” with a DD Form 4 dated 22 August 2017. Enlistment Guarantee Annex “B” should read to reflect: Option 1: “CULINARY SPECIALIST (CS/5YO) CLASS “A” SCHOOL GUARANTEE T+X requires 4 years active duty obligation and a voluntary extension of 12 months to meeting the rating, school, and program guarantee active duty obligation requirement and a voluntary extension of N/A months to meet the enlistment bonus requirement.”; Option 2: “EBTRG of $5,000”; and Option 3: “EBSR of $5,000.” Note: Petitioner successfully completed training requirements and is entitled to the Enlistment Bonus Source Rating in the amount of $5,000, and Enlistment Bonus for Training of $5,000. NPTU Ballston Spa will process Petitioner’s payment for the Enlistment Bonus. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
