Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to Sea Duty Incentive Pay Back-To-Back (SDIP-B). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 25 September 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. Petitioner awarded the Surface Force Independent Duty Corpsman (8425/L10A) Navy Enlisted Classification (NEC) on 1 August 2015. b. On 14 August 2015, Petitioner reported to ( ) for duty. is designated as Type 2 sea duty per reference (b). c. On 17 May 2017, Petitioner submitted NAVPERS 1306/7, Enlisted Personnel Action Request, requesting back-to-back Sea Duty; Commanding Officer recommended approval on 17 May 2017. d. On 27 November 2017, Petitioner issued BUPERS Order 3317 for assignment to . e. On 27 July 2018, Petitioner to for duty. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the criteria to receive SDIP-B per reference (c). However, because of administrative oversight, Petitioner’s request for back to back Sea Duty was not submitted and or adjudicated within the prescribed timeframe. Although the proper administrative requirements were not completed, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: SDIP-B request was submitted and received by cognizant authority 11 to 13 months prior to Prescribed Sea Tour completion date or Projected Rotation Date, whichever occurs later; it was approved. Petitioner, in coordination with his command completed the required SDIP-B NAVPERS 1070/613, Administrative Remarks and submitted it to Commander, Navy Personnel Command for inclusion in the Petitioner’s Official Military Personnel File. This change will entitle Petitioner to the Hospital Corpsman (HM) NEC 8425/L01A monthly Sea Duty Incentive Pay (SDIP) rate of $500 per month for 36 months effective 27 July 2018. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
