Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to have four reserve points be moved from previous years and that two points be added to anniversary years ending on May 22, 2017 and May 22, 2018. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on January 17, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On July 1, 1993, Petitioner entered the U.S. Naval Academy. c. Petitioner receives first commissioning on May 23, 1997. d. On May 22, 2005, Petitioner is released from active duty. e. On November 09, 2005, Petitioner enters Selected Marine Corps Reserve and his Anniversary date is established as July 1, 1993 per the RT04 screen located in Marine Corps Total Force System (MCTFS). f. During July of 2018, Petitioner’s anniversary date is corrected to May 23rd and the realignment of anniversary years. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. They stated Petitioner was credited with his attendance at the U.S. Naval Academy and his anniversary date was set from that credit. Time spent in the U.S. Naval Academy; therefore, the Petitioner’s anniversary was adjusted to his date commissioned in the USMCR on 23 May 1997 during an audit of his record. They recommend 4 paid drills be moved from the anniversary year ending 22 May 2019, 2 paid drills be added to the anniversary year ending 22 May 2017 and 2 paid drills be added to the anniversary year ending in 22 May 2018. This correction will give the Petitioner 22 satisfactory years of service. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded the erroneous anniversary date initially applied to the Petitioner’s record was administrative error and the Petitioner should credited for the satisfactory years of service prior to the correction of that error. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Authorizes service headquarters to move reserve points as necessary in order for the anniversary years [anniversary year of 22 May 2017 – 2 paid drills shall be added and anniversary year of 22 May 2018 – 2 paid drills shall be added]. Petitioner’s record shall reflect 22 years of satisfactory service. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
