Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner was authorized a Special Duty Assignment (SDA) Kicker. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 23 June 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 19 July 2010, Petitioner entered active duty. c. On 28 April 2016, Petitioner’s Careerist Active Duty SDA with extension/DI Duty request was submitted, and was approved by Headquarters, U.S. Marine Corps (HQMC) on 14 August 2016. d. On 22 August 2016, Petitioner signed an agreement to extend enlistment for 27 months in order to obligate service for assignment to e. On 5 July 2017, MARADMIN 350/17 (MCBul 7220. Fiscal Year 2018 (FY18) Selective Retention Bonus (SRB) Program and FY18 Broken Service SRB (BSSRB) Program) was published with the following: Any regular component first term or career Marine with an End of Current Contract (ECC) from 1 Oct 17 to 30 Sep 18. Zone A, B, and C Marines who submit a 48 month reenlistment in which they volunteer for an initial Free Military Occupational Specialty (FMOS) of 0911, 8411, or 8156 from 5 Jul 17 to 31 Dec 17 will rate a 20,000 reenlistment kicker in addition to the SRB allotted to the Marines PMOS. The awarding of the FMOSs 0911, 8411, or 8156 predicates the payment of the SDA kicker. Marines who are in training beyond 30 Sep 18 will be authorized payment of the SDA Kicker once MCTFS shows they have been awarded the new FMOS. The SDA kicker is open to all PMOSs who gain the FMOSs mentioned above. f. On 11 July 2017, Petitioner attended Drill Instructor School, and graduated on 27 September 2017. g. On 14 August 2017, Petitioner was issued WEB orders to Drill Instructor School, , for duty in billet MOS 0911. h. On 3 October 2017, Petitioner transferred from his unit, and on 28 October 2017, Petitioner arrived to i. On 11 October 2017, Petitioner’s Careerist Active Duty Reenlistment request was submitted, and was approved by HQMC on 24 October 2017. j. On 4 November 2017, Petitioner reenlisted for 4 years, with an End of Current Contract (ECC) of 19 July 2018 and End of Active Service (EAS) of 19 October 2020. k. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner submitted his reenlistment request within the SDA kicker window between 5 July 2017 and 31 December 2017; however, he reenlisted after graduation from DI school and therefore lost his eligibility. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The Petitioner was discharged and reenlisted on 4/5 July 2017, vice on 3/4 November 2017 with a term of 5 years and 1 month vice 4 years. Note: This change will entitle the member to a SDA Kicker of $20,000. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
