Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to compare the March 2019 Cycle 243 Navy Wide Advancement Examination (NWAE) against the missed Cycle 239 and Cycle 240 and be advanced retroactively. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 23 June 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 6 June 2017, Petitioner entered active duty. c. On 22 October 2018, this Board approved Docket number 8633-17 which changed paygrade E-3 effective 6 June 2017. d. In March 2019, Petitioner participated in the March 2019 Cycle 243 NWAE and was selected for advancement. e. On 16 September 2019, Petitioner was advanced to EM3/E-4. f. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board agreed Petitioner was eligible to participate in the missed Cycle 239 and Cycle 240 NWAE’s once the paygrade E-3 effective date was changed. After comparing Cycle 243 against the missed Cycles, Petitioner’s Cycle 239 NWAE Final Multiple Score (FMS) would have been 74.35 which did not exceed the minimum multiple score required of 84.80 to be advanced. Petitioner’s Cycle 240 NWAE FMS would have been 106.49 which exceeded the minimum multiple score required of 20.00 to be advanced. The Board finds the existence of an injustice warranting the following corrective action. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s March 2019 Cycle 243 NWAE was compared against the missed September 2018 Cycle 240 NWAE. Note: after comparison, Petitioner’s Final Multiple Score (FMS) for Cycle 240 was 106.49 which exceeded the minimum FMS required of 20.00 to be advanced to EM3. Petitioner’s date of advancement to EM3/E-4 is effective “16 June 2019” vice “16 September 2019” with a Time in Rate (TIR) date of “1 January 2019” vice “1 June 2019”. Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
