Pursuant to reference (a), Petitioner, an enlisted member of the Marine Corps, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected by removing his fitness report for the reporting period 10 May 2017 to 9 June 2017. 2. The Board reviewed Petitioner’s allegations of error and injustice on 28 July 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, found as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. Petitioner contends that enclosure (2), his adverse fitness report, should be removed because he failed a Physical Fitness Test (PFT) due to a medical issue he was experiencing at the time of the PFT. Petitioner failed the crunches portion of the PFT. c. Enclosure (3), an advisory opinion (AO) furnished by Headquarters, Marine Corps (MMRP-13), recommended Petitioner’s request be denied, because Petitioner failed to inform his Faculty Advisor at Sergeants Course that he was having a medical issue. The Board, however, took into consideration that Petitioner was recovering from the flu, which was documented in his medical record. The Board also noted that the Petitioner had an underlying abdominal medical condition that was not treated until 2018. CONCLUSION Upon review and consideration of all the evidence of record, the Board determined that Petitioner’s request warrants relief. The Board found the Petitioner was experiencing a medical event that would have released him from taking the PFT, if he had asked for an excusal for medical reasons. The Board thus concluded that Petitioner’s fitness report at enclosure (2) shall be removed. RECOMMENDATION In view of the above, the Board recommends the following corrective action: Petitioner’s naval record be corrected by removing his fitness report for the reporting period 10 May to 9 June 2017. In addition, ensure that the Performance Evaluation System, the database which generates the Master Brief Sheet, be modified appropriately. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
