Pursuant to the provisions of reference (a), Petitioner, a former enlisted member of the Navy, filed enclosure (1) with the Board for Correction of Naval Records (Board) requesting the correction of his middle name on his Report of Separation from the Armed Forces of the United States (DD Form 214) to " ." 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 6 November 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, naval records, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Enclosure (1) although the application was not filed in a timely manner, the Board found it in the interest of justice to waive the statute of limitations and consider your application on its merits. c. Petitioner enlisted in the Navy and began a period of active duty on 3 August 1977. All documents list his name as " ." He completed his enlistment and was honorably transferred to the Naval Reserve on 31 July 1981. He was issued a DD Form 214, with his middle name listed incorrectly as " ." CONCLUSION: Upon review and consideration of all the evidence of record, including a copy of a birth certificate provided by the Petitioner which lists his name as “ ” the Board concludes that Petitioner’s request warrants favorable action in the form of relief by changing his middle name on the DD Form 214 to “ .” In view of the above, the Board directs the following corrective action. RECOMMENDATION: That Petitioner’s naval record should be corrected to show that on 31 July 1981, he was issued a DD Form 214 with his middle name correctly list as “ .” Additionally, that he shall be issued a new Certificate of Release or Discharge from Active Duty (DD Form 214). That a copy of this Report of Proceedings be filed in Petitioner’s naval record. That no further relief be granted. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
