Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner was eligible for and received a Fiscal Year 19 (FY19) Special Duty Assigments (SDA) Kicker. 2. The Board, consisting of , , and reviewed Petitioner’s allegations of error and injustice on 22 September 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitoner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), the minimum tour length for a recruiter at a Marine Corps District is 36 months. Request for voluntary tour extensions are considered on an individual basis. The tour length for a recruiter may be involuntarily extended periodically to ensure the requirements of the recruiting service are met. c. On 15 December 2014, Petitioner entered active duty for 4 years. d. On 18 July 2017, Petitioner agreed to extend enlistement for 10 months for the purpose of obligated service for orders. e. On 21 September 2017, Petitioner arrived to for duty as an administrative specialist (MOS 0111). f. On 1 May 2018, Petitioner was promoted to Sergeant. g. In accordance with reference (c), This bulletin announces the SRB program and the BSSRB program authorized for FY19. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2018 are eligible for the FY19 SRB program. This will include: any regular component first term or career Marine with an End of Current Contract (ECC) from 1 October 2018 to 30 September 2019. Furthermore, zone A, B, and C Marines who submit a 48 month reenlistment in which they volunteer for an initial Free Military Occupational Specialty (FMOS) of 0911, 8411, or zone B and C Marines who volunteer as Marine Security Guard Detachment Commander from 5 July 2018 to 31 December 2018 will rate a 20,000 dollar SDA Kicker in addition to the PMOS bonus amount listed in section(s) 3.m, 3.n, and 3.o. The awarding of the FMOSs 0911, 8411, or the completion of predicates the payment of the SDA kicker. Marines who are in training beyond 30 September 2019 will be authorized payment of the SDA Kicker once MCTFS shows they have been awarded the new FMOS or once MCTFS shows they have completed the Marine Security Guard Detachment Commander School. The SDA kicker is open to all PMOSs who meet the prerequisites mentioned above. If no PMOS bonus is listed in section(s) 3.m, 3.n, and 3.o, the Marine rates a lump sum bonus of 20,000 dollars. h. On 9 July 2018, Petitioner’s 1st Term Active Duty SDA with Reenlistment and Recruiting Duty request was submitted to Headquarters, U.S. Marine Corps for approval. i. On 15 December 2018, Petitioner’s 10 month extension became operative. j. On 9 July 2019, Petitioner’s 1st Term Active Duty Reenlistment request was submitted to Headquarters, U.S. Marine Corps. On 15 July 2019, Petitioner’s request was approved. k. On 22 July 2019, Petitioner reenlisted for 4 years. l. On 13 March 2020, Petitioner arrived to RS for duty as a Recruiter (MOS 8411). m. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that a 1st Term Active Duty SDA with Reenlistment and Recruiting Duty request was submitted shortly after the new MCBUL 7220. Fiscal Year 2019 (FY19) Selective Retention Bonus (SRB) Program and FY19 Broken Service SRB (BSSRB) Program message was published; however, due to processing time, and no fault of petitioner, Petitioner’s extension became operative, making him ineligible to reenlist as an FY19 Marine. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 9/10 December 2018, vice on or about 21/22 July 2019 for a term of 4 years and 10 months. Note: This change will entitle Petitioner to a Special Duty Assignment (SDA) Kicker, $20,000. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
