Pursuant to reference (a), Petitioner, an enlisted member of the Marine Corps, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected by removing an Administrative Remarks (Page 11) 6105 counseling entry. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 15 September 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, found as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. Petitioner was issued enclosure (2), a Page 11 6105 entry counseling him due to failing his physical fitness test (PFT) that was required in order to attend Sergeants Course. Petitioner acknowledged entry and chose not to submit a rebuttal. c. Petitioner contends that he received the counseling in error because he did not fail an official PFT and that the score was not reported into his official training record. Petitioner also furnished enclosure (3), a letter from the issuing officer, who confirmed that the counseling entry was in fact mistakenly forwarded to Petitioner’s OMPF. d. The advocacy letter from the issuing officer noted that Petitioner was heavily involved in support of Reserve and Active Duty Marines, and community events that led up to his failed mock PFT. Additionally, he noted that the PFT failure did not warrant an adverse fitness report, and that Petitioner was able to pass the official PFT two weeks later. The issuing officer recommended that the Page 11 counseling entry be removed from Petitioner’s OMPF. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the advocacy letter, the Board finds the existence of an error and injustice warranting relief. The Board determined that the failed PFT was a mock PFT and not administered for official score. The Board also noted that Petitioner passed the official PFT two weeks later. The Board found that Petitioner did not receive an adverse fitness report following the failed mock PFT, and that the issuing officer did not intend for the counseling entry to be forwarded for inclusion in Petitioner’s OMPF. The Board thus concluded that the Page 11 counseling entry shall be removed from Petitioner’s OMPF. RECOMMENDATION In view of the above, the Board recommends the following corrective action. Petitioner’s record be corrected by removing enclosure (2), his 8 February 2017 Page 11 6105 counseling entry. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
