Pursuant to the provisions of the references, Petitioner, a former enlisted member in the United States Navy, filed the enclosure with this Board requesting a change to his naval record, specifically, to add a period of continuous active duty to his Certificate of Discharge or Release from Active Duty (DD Form 214). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 4 November 2019, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, as well as applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner served in the Navy from 30 April 2001 through 21 March 2017. Petitioner’s final period of enlistment began on 18 April 2014, for a period of six years. c. Prior to the completion of his final enlistment contract, Petitioner appeared before a General Court-Martial (GCM), beginning on 19 November 2015. The General Court-Martial Proceedings concluded on 3 March 2016. Petitioner was found guilty of violating Uniform Code of Military Justice Article 90 and Article 128. The Court sentenced you confinement for a period of eight months, reduction to paygrade of E-1, and a Bad Conduct Discharge. d. Petitioner’s DD Form 214 reflects on 21 March 2017, he was discharged from the Navy after 15 years, 4 months, and 22 months. Petitioner received a Bad Conduct Discharge and a reentry (RE) code of RE-4. e. Petitioner states that his entire service has been characterized unfavorably when in fact only his last enlistment period should be listed as such. Petitioner states that he had 14 years of honorable service before his last period of enlistment, and asks that his periods of enlistment prior to his last service contract be reflected as honorable. CONCLUSION: Upon review and consideration of all the evidence of record, the Board noted that Petitioner’s final period of enlistment began on 18 April 2014. When Petitioner signed his immediate reenlistment contract on 18 April 2014, he had served honorably in the Navy and met the qualifications for continued service. The Board determined that Petitioner’s discharge paperwork should reflect a period of continuous honorable service from 30 April 2001 through 17 April 2014, the day prior to his final enlistment period. In view of the above, the Board directs the following corrective action: RECOMMENDATION: That Petitioner be issued a Correction to Report of Separation from the Armed Forces of the United States (DD Form 215) to reflect a period of continuous honorable service from 30 April 2001 through 17 April 2014. That a copy of this report of proceedings be filed in Petitioner’s naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received by the Board on 13 August 2019. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
