Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner was credited with leave charged during transit time between ODS and first Naval Duty Station. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 18 August 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with the reference (b), administrative absences are authorized for specific circumstances as explained in this Instruction. They may include “permissive travel” to attend or participate in activities of an official nature to the benefit of the mission of the Department of Defense. Furthermore, in approving administrative absence requests, care must be taken to ensure that the planned absence clearly falls within the criteria provided; if it does not, the absence is subject to normal leave and liberty procedures. Administrative absences that exceed 30 days should be controlled at the Service headquarters level. c. On 30 June 2017, Petitioner was appointed as a in the active U.S. Navy with a designator code of 2100. d. On 6 July 2017, Petitioner was issued official new appointment orders. e. On 8 July 2017, Petitioner entered active duty and arrived to , for temporary duty under instruction. f. On 11 August 2017, Petitioner graduated from and transferred. g. On 15 September 2017, Petitioner arrived to for duty. h. On 20 September 2017, Petitioner was charged with leave for the period of 11 August 2017 to 8 September 2017 (29 days). i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that from the time Petitioner entered active duty and arrival to , Petitioner was not afforded with enough time to complete overseas screening/requirements. Petitioner did not previously belong to a unit, where some of these requirements could have been completed prior to executing orders. Petitioner was transferred after graduating ODS and was charged leave while completing all her administrative requirements prior executing her orders to . RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was authorized administrative absence from 11 August 2017 to 8 September 2017. Note: Petitioner will be credited with 29 days leave to her leave account. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
