Dear , This is in reference to your application for correction of your naval record pursuant to Title 10, United States Code, Section 1552. After careful and conscientious consideration of the entire record, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 14 January 2020. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. On 5 January 2015, MILPERSMAN 1820-050 was published. On 4 March 2015, RESPERSMAN 1500-010 change 5 was published. On 29 September 2015, your completed Aviation Machinists Mate (AD) correspondence course worth 17 points (reduced to 12). On 30 September 2015, you completed Military REQ PO1 correspondence course worth 8 points (reduced to 6), and Military REQ 3 & 2 correspondence course worth 11 points (reduced to 8). You requested that you receive a satisfactory year ending 28 November 2015 by either moving points or crediting correspondence course points; the Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that RESPERSMAN 1500-010 states that effective 1 October 2014, Commander, Navy Personnel Command ceased automated crediting of retirement points for completed correspondence courses. Sailors must receive approval form the appropriate authority to receive non-pay retirement point credit for correspondence courses that are on an Assistant Secretary of the Navy approved list. Upon completion of a correspondence course, sailors must provide the Navy Reserve Activity with a copy of their approved NAVPERS 1336/3, special request/authorization, and the course completion certificate within 30 days. Furthermore, the Board concluded that MILPERSMAN 1820-050 states that completed approved military correspondence courses in an eligible status the member may be credited with 1 point per 4 hours of instruction. Accordingly, you received the maximum points allowed under this instruction. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
