Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner was advanced to E-6 with a time in rate of 1 July 2018. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 22 November 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 16 June 2016, Petitioner was advanced to E5. c. Petitioner received an Early Promote recommendation via an Evaluation report & Counseling record (E1-E6) for the period of 16 June 2016 to 15 March 2017. d. On 18 October 2017, NAVADMIN 252/17 (March 2018 (Cycle 239) Navy-Wide Petty Officer (E4-E6) advancement examinations for USN, Full Time Support, and Canvasser Recruiter Sailors) was published. e. On 3 May 2019, Petitioner’s Commanding Officer executed an exception to policy request on behalf of Petitioner’s missed March 2018 (Cycle 239) Navy Wide Advancement Exam (NWAE) due to being deployed to a location without telecommunication or ability to administer the examination. f. On 16 June 2019, Petitioner was advanced to E6. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that due to no fault of his own, Petitioner was unable to take the March 2018 (Cycle 239) NWAE. Furthermore, after comparing exams March 2018 (Cycle 239) and September 2018 (Cycle 240), Petitioner would have advanced. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's Examination Profile Information and Exam Status sheet from the March 2018 (Cycle 239) NWAE is modified to read Exam Standard Score 53.53, PMA (Performance Mark Average) 98.00 (3.8), Service in Pay Grade 0.63 (0206), Awards 2.00, Education Points 0.00, PNA (Passed not advanced) 0.00, and FMS (Final Multiple Score) 154.16. Note: the Minimum Multiple required was 20.00 Petitioner was advanced to E-6 on 16 December 2018 with a time in rate of 1 July 2018. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
