Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to reinstate September 2018 (Cycle 240) Navy Wide Advancement Examination (NWAE) selection to E-4 and credit Petitioner with back pay. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on November 22, 2019 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 16 February 2018, Petitioner was advanced to E-3. c. On 2 May 2018, NAVADMIN 110/18 (September 2018 (Cycle 240) Navy-Wide Petty Officer (E4-E6) Advancement Examinations for USN, Full Time Support, and Canvasser Recruiter Sailors) was published. d. On 15 July 2018, Petitioner received and Early Promote recommendation via an Evaluation Report & Counseling record for the period of 1 March 2018 to 15 July 2018. e. In September 2018, Petitioner took the September 2018 (Cycle 240) NWAE, and was selected to E-4. f. On 16 November 2018, Petitioner was granted an Interim/Temporary SECRET clearance. g. On 16 September 2019, Petitioner was advanced to E-4. h. On 1 October 2019, Petitioner was advanced to E-5. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that the Petitioner’s command may have submitted and approved an Interim security clearance prior to September 2018 and Petitioner’s September 2018 (Cycle 240) NWAE should be validated. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s September 2018 (Cycle 240) NWAE was validated. Petitioner was advanced to E4 on 16 June 2019 with a time in rate date of 1 January 2019. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
