Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received a Selective Reenlistment Bonus (SRB) zone “C”. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 6 August 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 23 August 2005, Petitioner entered active duty. c. On 27 November 2013 to 8 December 2016, Petitioner was a production recruiter. d. On 1 November 2014, Petitioner was promoted to Staff Sergeant/E-6 and was awarded upon promotion Primary Military Occupational Specialties (PMOS) of 0629 (Radio Chief). e. In accordance with reference (b), this bulletin announces the SRB program authorized for FY17 and the continuation of the FY17 BSSRB program. First term Marines (Zone A) who reenlist on or after 1 July 2016 are eligible for the FY17 SRB program. Career Marines (Zone B, C, and E) who reenlist on or after 1 July 2016 are eligible for the FY17 SRB program. This will include: Any regular component first term or career Marine with an end of current contract (ECC) from 1 October 2016 to 30 September 2017. Zone C eligibility. Zone C applies to those active component Marines with 10 to 14 years of active military service. Marines with exactly 14 years of active service on the date of reenlistment may be paid a Zone C bonus if they have not previously received a Zone C bonus. Zone C lateral move SRB payments are only authorized for those MOS(s) designated with LM. Zone C SRB payments for Marines who reenlist for at least 48 months of obligated service are authorized as follows: zone “C” SRB for MOS 0629 Staff Sergeant/E-6, which is capped at $14,500 for 48 months of additional obligated service. f. On 27 September 2016, Petitioner’s Careerist Active Duty Reenlistment request was submitted, and was approved by Headquarters, U.S. Marine Corps on 3 November 2016. Petitioner’s End of Active Service (EAS)/End of Current Contract (ECC) was 30 November 2016. g. On 5 November 2016, Petitioner reenlisted for 4 years. h. On 1 October 2018, Petitioner was promoted to Gunnery Sergeant/E-7. i. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that while Petitioner was on recruiting duty, he was promoted to Staff Sergeant/E-6 and was awarded PMOS of 0629 upon promotion; however, command failed to realize that he was eligible for zone “C” SRB for MOS 0629. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The enlistment/reenlistment document (DD Form 4), executed on 5 November 2016 for a term of 4 years listed “REENLISTED FOR THE FOLLOWING INCENTIVE(S): “zone C SRB for MOS 0629 capped at $14,500 for 48 months of additional obligated service” vice “NONE”. Note: This change will entitle the member to a zone “C” SRB for MOS 0629, which is capped at $14,500 for 48 months of additional obligated service. Remaining obligated service to 30 November 2016 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
