Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner submitted a timely request for Health Professions Officer Incentive Pay (IP) effective 23 November 2016 and it was approved by cognizant authority. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 6 August 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), Eligible Medical Corps officers must submit requests for ISP to BUMED-M1C1 using the example provided in Appendix 2-J, via their CO. Furthermore, COs must endorse and forward all requests for ISP to BUMED-M1C1 with a recommendation dated within 30 days of the requested effective date and ensure that the effective date on the agreement has been verified to be correct following this instruction. Finally, ISP will not be paid in the same fiscal year in which the qualifying residency training is completed. The effective date for ISP must be calculated from the completion of the qualifying training plus 3 months. c. In accordance with reference (c), effective 1 October 2017, the Department of Defense (DoD) Health Professions Officers (HPO) Special and Incentive Pay Program was updated to reflect the changes from the review by the Services. The attached tables specify pay plan rates and board certification details of the Consolidated Special Pays (CSP) for HPO of the Active and Reserve Components. d. On 28 May 2015, Petitioner was appointed to the U.S. Navy as a Lieutenant with a designator code of 2300 (Medical Service Corps Officer). e. On 23 August 2016, Petitioner completed his internship. f. On 30 August 2016, Petitioner was issued a license to pratice as a Clinical Physchologist from the , Department of Health Professions. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that due to administrative error Petitioner’s request for IP was not processed correctly. Petitioner was eligible to receive IP effective 23 November 2016 vice 1 June 2019. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner received IP at the annual rate of $5000 from 23 November 2016 to 31 May 2019. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
