Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show blocks “12a” and “12c” of the DD Form 214 (Certificate of release or discharge from active duty) issued effective 30 September 2001. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 3 January 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner was issued a DD Form 214 for the period of 29 March 1978 to 31 May 1978 while he served in the U.S. Air Force. c. Petitioner was issued a DD Form 214 for the period of 28 August 1981 to 30 May 1984 when he reenlisted for 5 years. d. Petitioner was issued a DD Form 214 for the period of 31 May 1984 to 30 September 2001 when he was transferred to the Marine Corps Fleet Reserve. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following partial corrective action. The Board concluded that the issuance of the DD Form 214 provides recipients with a record of their active service with the Marine Corps at the time of transfer, release or discharge, and changes in status or component while on active duty. Petitioner was issued 3 DD Form 214s between the period of 29 March 1978 and 30 September 2001. Furthermore, the Board concluded that Petitioner’s last DD Form 214 blocks 12a and 12c were correct, but it should have captured his previous service in the Air Force in block 12d. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s DD Form 214, executed on or about 30 September 2001 is modified to read block 12d (Total Prior Active Service) “2 years, 11 months, and 5 days” vice “2 years, 9 months, and 3 days”. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
