Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received an Enlisted Bonus for Shipping (EBSHP). 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 11 August 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 23 January 2019, Petitioner enlisted for 8 years in the U.S. Navy Reserve, with a projected active duty service date of 4 June 2019. Furthermore, Petitioner signed a NAVCRUIT 1133/52 (Enlistment Guarantees) with the following options: Aviation Electronic, Electrical, & Computer Systems Technician (AV/5YO) Program guarantee (T+X), Enlistment Bonus for RTC PFA (EBPFA) $2,000, and an Enlistment Bonus for Source Rate (EBSR) $10,000. c. In accordance with reference (b), active component recruits in the AV-5YO rating, shipping between February and May, in FY-19 were eligible for an EBSHP $10,000 with the following requirements: EBSHP earned and payable upon graduation of RTC, and to be eligible for EBSHP, the initial or reclassification transaction must take place after 1 February 2019 with a ship date between February and May. NRC classifiers must list the EBSHP separately on the Enlistment Guarantee (NAVCRUIT 1133/52). EBSHP is considered earned upon graduation of RTC and may not be recouped due to reclassification or separation. d. On 7 February 2019, Petitioner was reclassified. e. On 26 February 2019, Petitioner entered active duty. f. On 17 May 2019, Petitioner received a Selective Enlistment Bonus for $12,000 in accordance with Petitioner’s Master Military Pay Account (MMPA). g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner reclassified on 7 February 2019 and his shipping date was changed from June to February making him eligible under the new Active Component Enlistment Bonus (EB) and Enlistment Loan Repayment Update message. Due to close proximity of events, NAVCRUIT 1133/52 was not created prior to shipping. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's NAVCRUIT 1133/52 (Enlistment Guarantees) signed on 7 February 2019 (Annex B to DD Form 4 dated 23 January 2019) listed an Option 4: EBSHP $10,000. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
