After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 25 August 2020. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion contained in Headquarters, U.S. Marine Corps memorandum 5420 MMEA of 19 November 2019; a copy of which was previously provided to you for comment. On 18 April 2011, you entered active duty. On or about 6 November 2012, you obtained a Primary Military Occupational Specialties (PMOS) of 4612 (Combat Graphics Specialist). On 1 April 2016, you were promoted to Sergeant/E-5. On 2 July 2018, MARADMIN 370/18 (MCBUL 7220. Fiscal Year 2019 (FY19) Selective Retention Bonus (SRB) Program and FY19 Broken Service SRB (BSSRB) Program message was published. This bulletin announces the SRB program and the BSSRB program authorized for FY19. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2018 are eligible for the FY19 SRB program. This will include: Any regular component first term or career Marine with an End of Current Contract (ECC) from 1 October 2018 to 30 September 2019. Additionally, Marines in Zones A, B, and C who have submitted for a 48 month reenlistment between 5 July 2018 through 30 September 2018 with a PMOS that is listed in section(s) 3.m, 3.n, and 3.o, and are subsequently approved, will rate a 10,000 dollar Early Reenlistment Kicker in addition to the PMOS bonus amount listed in section(s) 3.m, 3.n, and 3.o. After 30 September 2018, this Early Reenlistment Kicker will expire. Finally, you were eligible for a zone “B” SRB for PMOS 0521LM, E-5 & below which was capped at $31,500 for 48 months of additional obligated service. On 6 November 2018, your Careerist Active Duty Lateral Move (PMOS 0521 - Military Information Support Operations Marine) request was submitted. On 27 November 2018, your request was approved. On 8 December 2018, you reenlisted for 4 years and 3 months with an End of Current Contract of 28 February 2019. You requested an Early Reenlistment Kicker in the amount of $10,000; the Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that your reenlistment request was submitted on 6 November 2018, which was outside the FY19 Early Reenlistment Kicker submission window. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. Regarding your request for a personal appearance, the Board determined that a personal appearance with or without counsel will not materially add to their understanding of the issue(s) involved. Therefore, the Board determined that a personal appearance was not necessary and considered your case based on the evidence of record. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records.
