The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Petitioner received an Evaluation report & Counseling Record for the period of 12 December 2015 to 17 June 2016. Petitioner received a promotion recommendation of “Promotable” (3.60). c. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. Due to administrative oversight, Petitioner’s performance mark average (PMA) was calculated with the wrong evaluation (12 December 2015 to 17 June 2016). Therefore, using the correct evaluation (18 June 2016 to 3 February 2017), his score would have reflected 48 points vice 32 points scoring high enough to advance to E-5 via Cycle 235. RECOMMENDATION In view of the above, the Board directs the following corrective action. Petitioner's Examination Profile Information and Exam Status sheet from the Cycle 235 (March 2017) Navy-wide advancement examination is modified to read PMA/Evaluation Average: “48.00/3.80” vice “32.00/3.60”, and FMS (Final Multiple Score) "107.59 " vice "91.59 ". Note: Minimum Multiple Required score was 99.64. Petitioner was advanced to E-5 effective 16 December 2017 vice 16 February 2018. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. 4.
