Pursuant to the provisions of reference (a), Petitioner, an enlisted member of the Marine Corps, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her record be corrected by removing her 9 April 2018 Administrative Remarks (Page 11) counseling entry. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 6 October 2020, and pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, found as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. On 9 April 2018, Petitioner was issued enclosure (2), a Page 11 6105 counseling her for failing the run portion of her annual physical fitness test (PFT). She acknowledged the entry and chose to submit a written rebuttal. Petitioner contends that she dislocated her shoulder twice during the PFT and subsequently placed on light duty the same day as a result of her injury. Petitioner had shoulder surgery on 30 July 2018. Petitioner asserts that she should not have been documented as a PFT failure, and that the Page 11 entry is hindering her from conducting a lateral move and from furthering her career in the Marine Corps. c. Petitioner was issued enclosure (3), an adverse fitness report for the reporting period 1 April 2018 to 29 June 2018 as a result of her failed PFT, and the 9 April 2018 Page 11 6105 counseling entry. In her rebuttal, Petitioner explained the circumstances that led to her shoulder injury and failed PFT. Her reporting officials noted that Petitioner was in a full-duty status when she took her PFT. d. Pursuant to reference (b), “Marines injured while participating in a PFT/CFT may be given credit for a PPFT [partial PFT] if two out of three events were completed . . . prior to the injury.” Enclosure (4) reflects the PFT that Petitioner purportedly failed on 6 April 2018. It appears that Petitioner completed three events, but achieved a passing score for only the pull-ups and crunches portions of the PFT. e. A review of Petitioner’s pre- and post-surgery PFT history shows that she has consistently achieved first class PFTs and combat fitness tests (CFTs). CONCLUSION Upon review and consideration of all the evidence of record, the Board determined that Petitioner’s request warrants relief. The Board was convinced that Petitioner was injured during the conduct of her 6 April 2018 PFT, and that the injury caused her to fail the run portion of the PFT, resulting in an overall failure of the PFT. The Board also noted that subsequent to her shoulder surgery, she recovered and has since achieved first class PFTs and CFTs. The Board thus concluded that her 9 April 2018 Page 11 6105 counseling entry shall be removed from her official military personnel file (OMPF). The Board noted that the adversity of Petitioner’s fitness report was due to her failed PFT and the issuance of the Page 11 6105 counseling entry. Although not requested by the Petitioner, the Board determined that her fitness report shall also be corrected to reflect that she completed a partial PFT and that all adversity within the report shall be redacted. RECOMMENDATION In view of the above, the Board recommends the following corrective action. Petitioner’s naval record be corrected by removing enclosure (2), her 9 April 2018 Page 11 6105 counseling entry as well as her rebuttal statement (undated). Petitioner’s naval record be corrected by modifying enclosure (3), her fitness report for the reporting period 1 April 2018 to 29 June 2018 as follows: • Section A, Item 5.a. (Special Case/Adverse): remove mark • Section A, Item 6.b. (Marine Subject Of/Derogatory Material): remove mark • Section A, Item 8.b. (Special Information/PFT: remove “F190” and replace with “PART” • Section I (Directed and Additional Comments): redact all comments except the following two sentences: o “Directed Comment, Sect A, Item 6A: Received two Letters of Appreciation dated 24 May 2018 and 25 May 2018.” o “This is a not observed report due to insufficient observation time.” • Section J.2.: redact all entries • Section K.4. (Reviewing Officer Comments): redact all comments. • Section K.6. (Reviewing Officer Comments): redact mark from “I have attached a statement” • Remove all addendum pages (addendum pages 1 – 3) Petitioner’s training record be corrected using enclosure (4), the 6 April 2018 PFT/CFT Performance Worksheet, to reflect that she completed and passed a partial PFT on 6 April 2018. Any material or entries inconsistent with or relating to the Board’s recommendation be corrected, removed, or completely expunged from Petitioner’s record, and that no such entries or material be added to the record in the future. This includes, but is not limited to, all information systems or database entries that reference or discuss the expunged material. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
