Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner’s awards were uploaded and reflect 12 vice 10 points, and advanced to HM1/E-6 from the September 2018 (Cycle 240) Navy-Wide Advancement Exam (NWAE). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 11 August 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 16 December 2014, Petitioner was advanced to HM2/E-5. c. On 15 December 2015, Petitioner received a Navy and Marine Corps Commendation medal for the period of October 2012 to December 2015 (3 points). d. On 5 October 2016, Petitioner received The Surgeon General of the Navy letter (1 point). e. On 30 April 2018, Petitioner received a Navy and Marine Corps Achievement Medal (Gold star in lieu of the second award) for the period of 24 July 2017 to 30 April 2018 (2 points). f. In accordance with reference (b), this NAVADMIN announced the September 2018 (Cycle 240) Navy-wide advancement examination (NWAE) for advancement in rate of U.S. Navy (USN), Full Time Support and Canvasser Recruiter Sailors. Exam date for E-6 was 6 September 2018. The minimum time-in-rate (TIR) date must be on or before 1 January 2016 for E6. Furthermore, compute performance mark average (PMA) using all evaluations in the current rank of the candidate with an ending date that falls within the following time period: E6 exam - 1 September 2015 to 31 August 2018. g. In September 2018, Petitioner took the HM1/E-6 exam, Cycle 240, and scored a Final multiple of 183.38; however, a minimum multiple required was 184.68. Petitioner’s awards points was 10 (Award NAVADMIN 280/06 or 141/07 (2 points), Navy/Marine Corps Achievement Medal – 30 June 2011 (2 points), Combat Action Ribbon (2 points), Good Conduct Medal Active – 2 (4 points)). h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that per BUPERSINST 1430.16F, maximum award points authorized for E-6 is 12 points; however, Petitioner was only awarded 10 points because not all of his awards had been uploaded to his record. Furthermore, since Petitioner failed to advance by 1.3 points, if he had been awarded 12 points vice 10 points, he would have been allowed to advance from September 2018 Cycle 240. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner's Examination Profile Information and Exam Status sheet from the September 2018 Cycle 240 Navy Wide Advancement Exam (NWAE) listed awards was “12” vice “10”, and FMS (Final Multiple Score) was "185.38" vice "183.38". Note: The Minimum Multiple Required was 184.68. Petitioner was advanced to HM1/E-6 on 16 June 2018 with a time in rate of 1 January 2018. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
