Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to establish entitlement to a Fiscal Year 2019 (FY19) Aircraft Maintenance Kicker. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 14 February 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. c. Petitioner executed DD Form 4, Enlistment/Reenlistment Document on 26 November 2014 for a term of 4-years; end of current contract (ECC) 25 November 2018. d. Petitioner executed NAVMC 321A, Agreement to Extend Enlistment on 6 September 2017 for a term of 14-months; changing ECC to 25 January 2020. e. Petitioner submitted Reenlistment Extension and Lateral Move Request (RELM) on 16 August 2018, requesting to reenlist for a term of 4-years for the FY19 Aircraft Maintenance Kicker. f. On 3 January 2019, Headquarters Marine Corps administratively closed the request to reenlist for 48-months because Petitioner’s extension had become operative on 26 November 2018. g. Petitioner was promoted to Gunnery Sergeant on 1 August 2019. h. Petitioner executed DD Form 4, Enlistment/Reenlistment Document on 10 December 2019 for a term of 4-years and 2 months. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner met the basic eligibility criteria for the FY19 Aircraft Maintenance Kicker at the time of RELM submission in accordance with Marine Corps Administrative message 370/18. However, as a result of untimely processing of Petitioner’s reenlistment request, his extension became operative, thereby rendering him ineligible for reenlistment and the FY19 Aircraft Maintenance Kicker. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner executed DD Form 4, Enlistment/Reenlistment Document on 15 November 2018 for a term of 4-years and 1-month vice executing reenlistment on 10 December 2019 for a term of 4­years and 2-months. Note: Petitioner’s 14-month extension executed on 6 September 2017 does not become operative. Petitioner’s End of Active Service (EAS) and ECC are changed in the Marine Corps Total Force System (MCTFS) to reflect “14 December 2022”vice “9 February 2024”. This change will entitle Petitioner to the FY19 Aircraft Maintenance Kicker for $20,000 (before taxes). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
