Docket No. 8223-19 Ref: Signature Date Dear : This is in reference to your application for correction of your naval record pursuant to Section 1552 of Title 10, United States Code. After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 27 October 2020. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of the Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record, and applicable statutes, regulations, and policies. The Board also considered the 22 October 2019 advisory opinion (AO) furnished by the Navy Physical Readiness Program Section (OPNAV N170), which was previously provided to you. Although you were afforded an opportunity to submit a rebuttal, you did not do so. The Board carefully considered your request to enter a medical waiver for Physical Readiness Test (PRT) results and to remove your PRT Failure entry for Cycle 1-19. You contend that you tried to submit your medical waiver for curl-ups but the Command Fitness Leader (CFL) would not accept the waiver due to it being singed after 30 June 2019. The OPNAV N170 AO determined that your NAVMED Form 6110/4 was missing required information as stated in OPNAVINST 6110.1J and Operating Guide 6. Specifically, Section 5 was not approved and endorsed by the commanding officer (CO) and Section 3 was not signed by the Authorized Medical Department Representative (AMDR). The Board noted that the NAVMED 6110/4 you submitted with your petition included the AMDR signature in Section 3 but did not include your CO’s signature and date. Consequently, the Board concurred with the AO that your Cycle 1-19 PRT waiver cannot be entered into your Physical Readiness Information Management System (PRIMS) record. The Board recommends you contact your CO and obtain a Letter of Correction, excusing you from the PRT due to CFL mismanagement, and submit to OPNAV N170 so that your record can be corrected. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
