Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to reflect DD Form 214, Certificate of Release or Discharge from Active Duty dated 31 December 1998, block 12a to read 9 July 1980, block 12e to read 1-year inactive service and block 28 to account for total service time. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 25 August 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 9 July 1979, Petitioner enlisted in the United States Naval Reserve. b. On 8 July 1980, Petitioner entered active duty. c. On 2 May 1984, Petitioner was discharged and immediately reenlisted. d. On 31 December 1998, Petitioner was transferred to the Fleet Reserve under the Temporary Early Retirement Authority. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of errors warranting the following corrective action. Petitioner’s DD Form 214 dated 31 December 1998 does not reflect immediately reenlisting on 3 May 1984 and the total prior inactive service time is incorrect. However, the Board determined prior active duty service was accounted for on DD Form 214 dated 2 May 1984 and block 28 of DD Form 214 dated 31 December 1998 is correct; therefore, under these circumstances, partial relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s DD 214 dated 31 December 1998, block 12a (Date Entered AD this Period) is changed to “3 May 1984” vice “3 August 1984”, and block 12e (Total Prior Inactive Service) is changed to “01 00 00” vice “00 11 24”. The part of Petitioner’s request for corrective action that exceeds the foregoing is denied. Petitioner’s 3-years, 9-months and 25-days of service from 8 July 1980 is captured on DD Form 214 dated 2 May 1984. Block 28 of DD Form 214 dated 31 December 1998 is correct as it identifies the reason for separation during the accounted for period, not total active service. To calculate total active duty service, add blocks 12c and 12d which equals 18-years, 5-months, and 23-days. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
