Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received a Selective Reenlistment Bonus (SRB) with an award level of 1.5. 2. The Board, consisting of , , and reviewed Petitioner’s allegations of error and injustice on 1 September 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 3 August 2005, Petitioner entered active duty. c. In accordance with reference (b), this NAVADMIN (Selective Reenlistment Bonus Update May 2018) announced revised Selective Reenlistment Bonus (SRB) award levels and reenlistment policy for Active Component (AC). The member was eligible to a zone “C” SRB with an award level of 1.5 ($45,000 award ceiling) for the STS. d. On 17 September 2018, Petitioner’s NPPSC 1160/1 (Command Career Request) was submitted, and was approved by cognizant authority on 21 September 2018. e. In accordance with reference (c), this NAVADMIN (Selective Reenlistment Bonus Update November 2018 and the Implementation of a Pay for Performance Pilot (Corrected Copy)) corrected policy for Combat Zone Tax Exclusion (CZTE) and Early Promote (EP) Sailors and announces revised selective reenlistment bonus (SRB) award levels and reenlistment policy for active component (AC). Furthermore, increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN effective 16 January 2019. The member was eligible to a zone “C” SRB with an award level of 1.0 ($45,000 award ceiling) for the STS. f. On 11 March 2019, Petitioner’s SRB request was approved. g. On 18 March 2019, Petitioner reenlisted for 6 years, and received a zone “C” SRB with an award level of 1.0. h. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner’s reenlistment request was approved on 21 September 2018, and an OPINS request was approved on 11 March 2019. Petitioner’s command failed to recognize the new SRB message published on 17 December 2018, which decreased levels effective 30 days after the release of this NAVADMIN, therefore they were unable to submit an OPINS request in a timely manner. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 9/10 January 2019, vice on 17/18 March 2019 for a term of 6 years. Note: This change will entitle the member to a zone “C” SRB with an award level of 1.5 ($45,000 award ceiling) for the STS rate. Remaining obligated service to 19 March 2019 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
