Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to have advancement of EVT1 (E6) backdated effective from the September 2018 (Cycle 240) Navy Wide Advancement Exam (NWAE). 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on April 9, 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On May 21, 2019, Petitioner’s exam profile sheets reflect selection to EVT1 (E6) from the March 2019 (Cycle 243) NWAE. c. Petitioner contends he was not afforded the opportunity to take advancement examination for the September 2018 (Cycle 240) NWAE. He asserts the examination was requested and ordered, however, due to the closing of the Personnel Support Detachment the testing documents were destroyed. d. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board determined the Petitioner met eligibility requirements for the September 2018 (Cycle 240) NWAE for advancement to E6 and due to administrative error did not have the opportunity to take the examination. The Board concluded when comparing the September 2018 (Cycle 240) NWAE his Final Multiple Score (FMS) for March 2019 (Cycle 243) NWAE the Petitioner met the minimum FMS for advancement. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s FMS for the September 2018 (Cycle 240) exam is 170.81. The minimum FMS required for advancement to ETV1 (E6) from September 2018 (Cycle 240) was 163.46. Petitioner advanced to ETV1 (E6) effective June 16, 2019 with a time in rate date of January 1, 2019. Note: Defense Finance & Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
