After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board for Correction of Naval Records, sitting in executive session, considered your application on 1 September 2020. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations and policies. In addition, the Board considered the advisory opinion contained in Community Management Support Branch memorandum 1160 Ser B328/237 of 11 December 2019; a copy of which was previously provided to you for comment. On 15 June 2015, you entered active duty. On 14 May 2018, NAVADMIN 119/18 (Selective Reenlistment Bonus Update May 2018) was published listing a zone "A" SRB with an award level of 4.0 ($45,000 award ceiling) for the ND/5343 rate/NEC. Furthermore, it states that SRB reenlistment requests for AC must be submitted to Community Management Support Branch (BUPERS-328) via Officer Personnel Information System (OPINS) or Navy Standard Integrated Personnel System (NSIPS) 35 to 120 days in advance of the requested reenlistment date. On 21 November 2018, you were issued official change duty orders (BUPERS order: 3258) without obligated service. Your EAOS (End of Active Obligated Service) was 14 June 2019, and your SEAOS (Soft End of Active Obligated Service) was 14 June 2021. On 8 April 2019, you transferred from , and arrived at for duty on 8 May 2019. On 11 June 2019, NAVADMIN 129/19 (Selective Reenlistment Bonus and Pay for Performance Pilot Update June 2019) was published listing a zone "A" SRB with an award level of 0.0 ($45,000 award ceiling) for the ND/M2DV (5343) rate/NEC, with increased award levels effective immediately and decreased levels effective 30 days after the release of this NAVADMIN. On 14 June 2019, you reenlisted for 5 years. You requested that the effective date of your reenlistment be backdated to 15 December 2018; the Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that no OPINS request was ever submitted nor was there any evidence of when you began your reenlistment process. In this connection, the Board substantially concurred with the comments contained in the advisory opinion. It is regretted that the circumstances of your case are such that favorable action cannot be taken. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice. Sincerely,
