Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner received a Selective Reenlistment Bonus (SRB) with an award level of 1.5. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 20 October 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 5 May 2015, Petitioner entered active duty with an end of active obligated service (EAOS) of 4 May 2019. c. In accordance with reference (b), this NAVADMIN announces revised Selective Reenlistment Bonus (SRB) award levels and reenlistment policy for Active Component (AC) and Full-Time Support (FTS). Furthermore, increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Finally, reenlistment requests for the following SRB award levels will be approved based on quota availability. SRB reenlistment requests for FTS are currently not being accepted. SRB reenlistment requests for AC must be submitted to Community Management Support Branch (BUPERS-328) via Officer Personnel Information System (OPINS) or Navy Standard Integrated Personnel System (NSIPS) 35 to 120 days in advance of the requested reenlistment date for the Sailor. MM(SW) rating, zone “A”, listed an award level of +1.5. d. In accordance with reference (c), This NAVADMIN corrects policy for Combat Zone Tax Exclusion (CZTE) and Early Promote (EP) Sailors and announces revised selective reenlistment bonus (SRB) award levels and reenlistment policy for active component (AC) and fulltime support (FTS). Furthermore, increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN (15 January 2019). Finally, reenlistment requests for the listed SRB award levels will be approved based on quota availability. SRB reenlistment requests for FTS are currently not being accepted. SRB reenlistment requests for AC must be submitted to Community Management Support Branch (BUPERS328) via Officer Personnel Information System (OPINS) or Navy Standard Integrated Personnel System (NSIPS) 35 to 120 days in advance of the requested reenlistment date for the Sailor. MM(SW) rating, zone “A”, listed an award level of -1.0. e. On 16 January 2019, Petitioner reenlisted for 5 years. f. On 28 March 2019, COMNAVPERSCOM notified PERSUPP DET via message that SRB entitlment was based on an award level of 1.0. g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner should have been advised to change reenlistment date prior to the decreased levels becoming effective 30 days after the release of NAVADMIN 305/18 of 17 December 2018. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 13/14 January 2019, vice on 15/16 January 2019 for a term of 5 years. Note: This change will entitle the member to a zone “A” SRB with an award level of 1.5 vice 1.0 ($30,000 award ceiling) for the MM (SW) rate. Remaining obligated service to 4 May 2019 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)) and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
