Pursuant to the reference, Petitioner, a former enlisted member of the Navy, filed the enclosure with this Board requesting that his name as reflected on his Certificate of Release or Discharge from Active Duty (DD Form 214) be changed from . 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 9 March 2020, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although the enclosure was not filed in a timely manner, it is in the interest of justice to waive the statute of limitations and review the application on its merits. c. Petitioner enlisted in the Navy and served honorably from 11 September 1961 to 10 September 1963. Petitioner’s service record reflects the name with which he enlisted: d. Petitioner states that when he was nine years old, he started using the last name of his stepfather so that there would be unity among the family names. He enlisted with his stepfather last name of . e. Petitioner provides a copy of his birth certificate in support of his application, which reflects the name f. Petitioner requests that his DD Form 214 be changed to reflect his birth name of CONCLUSION: Upon review and consideration of all the evidence of record, the Board noted that the Department of the Navy relied upon information provided by Petitioner when he enlisted and that the DD Form 214 does not reflect an error. However, the Board found that Petitioner is entitled to correction to his name to address an injustice. The Board determined that Petitioner’s name on his DD Form 214 should be changed to align with his birth name, from . RECOMMENDATION: In view of the above, the Board directs the following corrective action: That Petitioner’s Certificate of Release or Discharge from Active Duty(DD Form 214) be corrected to reflect his birth name of , and that Petitioner be issued a new DD Form 214. That a copy of this report of proceedings be filed in Petitioner’s naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner’s application was received by the Board on 19 November 2018. 4.
