Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his Certificate of Release or Discharge from Active Duty (DD Form 214) be corrected to show he was awarded the Navy Unit Commendation, Combat Action Ribbon, and Purple Heart Medal. Enclosures (1) through (4) apply. 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 9 November 2020, and pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Petitioner’s allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of Petitioner’s application together with all material submitted in support thereof, relevant portions of his naval record, and applicable statutes, regulations, and policies, to include the 25 August 2017 guidance from the Office of the Under Secretary of Defense for Personnel and Readiness (Kurta Memo), the 3 September 2014 guidance from the Secretary of Defense regarding discharge upgrade requests by Veterans claiming post-traumatic stress disorder (PTSD) (Hagel Memo), and the 25 July 2018 guidance from the Under Secretary of Defense for Personnel and Readiness regarding equity, injustice, or clemency determinations (Wilkie Memo). 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, the statute of limitation was waived in accordance with the Kurta Memo. c. Petitioner states the awards were submitted for duties and actions completed prior to his separation from active duty, but awarded after his separation from active duty. He is seeking medical assistance for Post-Traumatic Stress Disorder and the Department of Veterans Affairs is requesting a copy of his DD Form 214 showing evidence of his Purple Heart. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of enclosures (2) through (4), the Board concludes that Petitioner’s request warrants relief. All awards have been verified in the appropriate data bases. RECOMMENDATION In view of the foregoing, the Board finds the existence of an injustice warranting the following corrective action. Petitioner’s naval record be corrected to show that he was awarded the Combat Action Ribbon, Navy Unit Commendation, and Purple Heart Medal. Petitioner be issued a Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215) to reflect the corrections above. A copy of this Report of Proceedings be filed in Petitioner’s naval record. No further relief be granted. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
