Pursuant to the provisions of reference (a) Subject, hereinafter referred to as Petitioner, filed enclosure (1) with this Board requesting, in effect, that the applicable naval record be corrected to show Petitioner was eligible for and entitled to receive both Selective Retention Bonus (SRB) and 72 Month Lateral Move (LM) Initiative. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 10 November 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 10 August 2015, Petitioner entered active duty. c. In accordance with reference (b), this bulletin announces the SRB program and the BSSRB program authorized for FY19. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2018 are eligible for the FY19 SRB program. This will include any regular component first term or career Marine with an End of Current Contract (ECC) from 1 October 2018 to 30 September 2019. Zone A Marines electing to LM in FY19 into PMOSs listed in section 3.m with the LM designation, will be given the opportunity to reenlist for 72 Months. Marines who execute a LM into one of these PMOSs for 72 months will rate a 40,000 dollar initiative in addition to the PMOS bonus listed in section 3.m. The LM initiative may not be coupled with any kicker. Zone A PMOS bonus payments for Marines who reenlist for at least 48 months obligated service are authorized as listed below in dollars (bonuses for Marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.j). Additionally, it listed PMOS 0365LM, Corporal/E-4 $27,000. d. On 10 January 2019, Petitioner signed NAVMC 11537 (Reenlistment Extension Lateral Move (RELM) request) requesting a 6 year reenlistment and a SRB/Lateral move kicker. Certified by Career Planner on 28 March 2019. e. In accordance with reference (c), MOS 0365, Infantry Squad Leaders are created via the Squad Leader Development Program (SLDP) by a lateral move from the Infantry MOS of Rifleman (0311), Machine Gunner (0331), Mortar-man (0341), Infantry Assault Marine (0351), or Antitank Missile Gunner (0352). Prerequisites are: (1) Must be a volunteer in the grade of Corporal or Sergeant. (2) Must have a minimum of 3 and no more than 6 years in service. (3) No derogatory page 11 entries within the last 12 months. (4) No non-judicial punishments (NJPs) within the last 12 months and with no more than 2 NJPs during the current contract. (5) No adverse fitness reports within the last 12 months. (6) No courts martial convictions. (7) Must be a graduate of: (a) Advanced Infantry Marine Course (M10M3X2 or M03M3X4). (b) Advanced Machinegun Course (M10H6A2 or M03H6A4). (c) Advanced Mortar Course (M10H5H2 or M03H5H4). (d) Advanced Assault Marine Course (M10MUS2 or M03MUS4). (e) Advanced Anti-Armor Course (M10MUR2 or M03MUR4). (f) Scout Sniper Course (M0281Z9 or M0381Z4 or M1081Z2). (8) Must be complete in all professional military education requirements for Corporal. Requirements are: (1) Be selected by the First General Officer in the chain-of-command to the squad leader development program. 3110 NAVMC 1200.1E 3-37 Enclosure (1) (2) Complete the Infantry Small Unit Leaders Course (M030304) at (3) Complete the Sergeants Course. f. In accordance with reference (d), the FY19 SRB program will be terminated 30 days after the release of this MARADMIN (28 June 2019). Marines with an ECC during FY19 will no longer be eligible for an SRB. A FY19 ECC is defined as any Marine who has an ECC on the date of reenlistment between 1 October 2018 and 30 September 2019. g. On 22 July 2019, Commanding General, 2nd Marine Division recommended to Commandant of the Marine Corps approval of Petitioner’s request for lateral move. h. On 25 July 2019, Petitioner’s 1st Term Active Duty Lateral Move was submitted, and was approved by HQMC on 30 July 2019. i. On 6 August 2019, Petitioner reenlisted for 4 years. j. On 1 September 2019, Petitioner was promoted to Sergeant/E-5. k. On 11 October 2019, Petitioner graduated from Infantry Small Unit Leaders Course 4-19. l. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner started the process in a timely manner; however, due to processing time and no fault of Petitioner, he was unable to reenlist prior to the termination of SRB. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was discharged and reenlisted on 26/27 June 2019 vice on 5/6 August 2019 for a term of 6 years vice 4 years. Note: This change will entitle the member, upon satisfying all requirements, to a zone “A” SRB for MOS 0365, which is capped at $27,000 for 48 months of additional obligated service. Remaining obligated service to 9 August 2019 will be deducted from SRB computation. Furthermore, Petitioner will be entitled to a $40,000 72 Month Lateral Move (LM) Initiative. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
