Pursuant to reference (a), Petitioner, an enlisted member of the Marine Corps, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her record be corrected by adjusting her date of rank (DOR) in the grade of gunnery sergeant and that she be returned all pay lost resulting from any correction of DOR. 2. The Board, consisting of , reviewed Petitioner’s allegation of injustice on 2 June 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegation of error and injustice, found as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulation within the Department of the Navy. b. Petitioner failed selection by the Fiscal Year (FY) 2018 Gunnery Sergeant Promotion Selection Board. Subsequently, Petitioner discovered that the Marine Corps Total Force System (MCTFS) improperly reflected her assignment to the Body Composition Program (BCP) on three occasions from 18 February 2014 to 09 April 2017, from 10 April 2017 to 01 June 2018 and finally on 02 June 2018. On 15 March 2019, Petitioner’s CommandingOfficer requested that the Director, Manpower Information Systems Support Activity, correct the erroneous MCTFS entries. The erroneous entries were removed, and on 06 June 2019 Petitioner was selected by the FY 2019 Gunnery Sergeant Promotion Selection Board. c. Petitioner states in her request for relief that, in accordance with reference (b), the Marine Corps Body Composition and Military Appearance Program, enlisted Marines are placed in a promotion restriction status while assigned to the BCP. Petitioner asserts that the FY 2018 Gunnery Sergeant Promotion Selection Board failed to select her while she was incorrectly assigned to the BCP. CONCLUSION Upon review and consideration of all the evidence of record, the Board determined that Petitioner’s request warrants relief. In this regard, the Board noted that in accordance with reference (b), enlisted Marines are placed in a promotion restriction status while assigned to the BCP, and that the FY 2018 Gunnery Sergeant Promotion Selection Board convened on 18 April 2018, at that time Petitioner was incorrectly assigned to the BCP. The Board also noted that, once the error in the MCTFS was corrected, Petitioner was selected by the FY 2019 Gunnery Sergeant Promotion Selection Board. The Board thus concluded that Petitioner’s DOR shall be corrected to reflect the DOR she would have received, had she been selected by the FY 2018 promotion selection board. The Board also concluded that Petitioner’s record shall also be audited to determine if she is due any retroactive pay and allowances associated with her DOR adjustment. RECOMMENDATION In view of the above, the Board recommends the following corrective action: Petitioner’s naval record be corrected by changing her DOR in the grade of gunnery sergeant E-7 to the DOR she would have received, had she been selected by the FY 2018 Gunnery Sergeant Promotion Selection Board. The Defense Finance and Accounting Service (DFAS) complete an audit of Petitioner’s records and make payment of any money that Petitioner may be entitled. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
